These terms and conditions (“T&C”) constitute a legally binding agreement and form part of the terms and conditions governing the acquisition from SACNET, SA, a company incorporated under Portuguese law and registered in the Cascais commercial registry office under corporate identification number 509791484, with registered office at Talaíde Park, Estrada Octávio Pato, nº 177, Edif. A, A3, 2785-783 S. Domingos de Rana , (“Sacoor”) by any Sacoor Brothers customer (“Customer”) of articles through the website www.sacoorbrothers.com (“Website”).

The Website is operated by Sacoor.

The Customer must ensure that he/she has carefully read the information contained in these T&C, taking into account that they will be directly applicable to the order of articles made through the Website.

By accepting the T&C, the Customer declares that he/she has the necessary capacity to enter into the Contract, namely being of legal age (18 years), and that he/she has understood and accepts to be bound by all of its provisions.

If the Customer is a legal entity, these T&C will apply with the necessary adaptations.

1. ORDERING AND PAYMENT

It is currently only possible to order electronically and receive articles from Sacoor for the following countries: Albania, Andorra, Armenia, Austria, Belarus, Belgium, Bosnia and Herzegovina, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Georgia, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Macedonia, Malta, Moldova, Monaco, Montenegro, Netherlands, Norway, Poland, Portugal, San Marino, Serbia, Slovakia, Slovenia, Spain, Sweden, Turkey, Vatican City.

When placing an order, the Customer must choose the payment method. Sacoor offers the following payment methods: (i) credit card, (ii) provision of a reference for payment by Multibanco (exclusive to Portugal), (iii) MBWAY (exclusive to Portugal) and (iv) Paypal. Provided that all conditions are met, the Customer may also pay part or all of the order price with their reward points accumulated through the Sacoor Club.

By clicking on the “Authorize Payment” option, the Customer accepts that he/she wishes to pay the total amount indicated for the item(s) purchased, including any costs related to shipping and delivery of the same. For payments made by Multibanco, the Customer must pay for the order within 3 (three) days after placing the order, otherwise it will be cancelled and considered ineffective.

The delivery address for purchased items will be the one stated on the order.

Once the order has been placed and the necessary checks have been carried out by Sacoor, including confirmation of payment for the order, the Customer will receive an email with notice of receipt of the order.

If, within five days of sending the order receipt notice, Sacoor is unable to ship the order, it will inform the Customer of this fact and may cancel the order.

2. INVOICE

The Customer may request the issuance of an invoice with their details, including their tax number, and must enter this information in the respective fields where data relating to the issuance of the invoice is requested.

3. ORDER STATUS

Sacoor will inform the Customer, via email, as soon as it begins preparing the order, also informing them of its progress and including a hyperlink that will allow them to track the status of the order.

Once the order is ready for delivery, the Customer will receive an email with the expected delivery date. The delivery point will be the delivery address indicated by the Customer, a Sacoor boutique or one of the participating Pick up points, as chosen by the Customer.

The Customer can also track the status of their order through the field “Orders Placed ” when logging into the Website.

The Customer may contact Sacoor's Customer Care service to obtain information about the delivery of an order, using the contact details indicated in Clause 12 below.

4. MODIFICATION AND CANCELLATION OF THE ORDER

The Customer may modify their order until it is in the “Order in Preparation” status. They may also cancel the order within 14 days.
For more information on how to confirm the status of your order, please see Clause 12 below.
To modify or cancel the order, the Customer must contact Customer Care as soon as possible, using the contact details indicated in Clause 12 below.

5. DELIVERY CONDITIONS

The Customer will receive their order at the address of their choice (except PO boxes), in a Sacoor boutique of their choice or at one of the participating Pick Up points.

Shipping rates will be applied per order. The exact price of each shipment will depend on the country and delivery conditions and are detailed in the order receipt email.

Deliveries are made between 9am and 6pm local time. To receive the order, it is necessary to ensure that someone is at the indicated address. During promotions, the delivery time may be longer than usual, but never more than 30 days from the date of the order.

The following holidays will not be considered “business days” for the purposes of any deadline for dispatching the respective order to the carrier:

Delivery times after dispatch may only be met if there are no external factors beyond the reasonable control of Sacoor or its suppliers that make it impossible, such as holidays at the delivery locations or in the countries through which the goods travel, such as public holidays, earthquakes, acts of terrorism, floods, general strikes, riots, rebellions or coups d'état.

6. IMPOSSIBILITY OF DELIVERY

In cases where the Customer has opted for home delivery, the Customer must ensure that he/she will be at the address indicated at the time of delivery of the order (or someone on his/her behalf can sign the proof of delivery). If, after two attempts to deliver the order to the home, the Customer is not available to receive the order, new information will be provided to the Customer regarding the location where it can be collected. The Customer will have a period of 15 working days from the date of the second delivery attempt to collect the order at the location indicated. If the Customer does not collect the order within the indicated period, Sacoor will collect it and refund the total amount paid by the Customer, with the exception of the costs incurred in sending the order.

If the Customer has chosen to receive the order at a Sacoor boutique, he/she must collect it from the selected boutique within fifteen days of confirmation of delivery. If this period has elapsed and the Customer has not collected the order, it will be returned to the Sacoor warehouse and cancelled. In the event of cancellation of the order due to failure to collect it within the period stipulated above, Sacoor will refund the Customer the full amount, with the exception of costs relating to shipping the order, if applicable.

If the Customer has chosen to collect the order at a Pick Up point, he/she must collect it from the chosen Pick Up point within fifteen days after confirmation of delivery, otherwise it will be returned to Sacoor and cancelled. In the event of cancellation of the order due to failure to collect it within the period stipulated above, Sacoor will reimburse the Customer for the full amount, with the exception of the costs incurred in sending the order.

7. TRANSFER OF RISK

The risk of deterioration of the items ordered is borne by the Customer from the moment they are delivered.

8. WARRANTIES

The items delivered to the Customer will, as a rule, correspond to those selected on the Website, except in cases where a given item has been manufactured using artisanal processes (brushing, waxing, aging, etc.) in which small differences may be seen between items of the same reference.

Sacoor only sells items in perfect condition, so if, exceptionally, the Customer receives a defective item, Sacoor will comply with all obligations provided for in the applicable legislation regarding the guarantee. In this case, the Customer must contact Customer Care using the contact details indicated in Clause 12 below.

If the Customer is not satisfied with any item received due to material or manufacturing faults, including any damage incurred in transit, the Customer may return the items in accordance with the returns instructions set out in Clause 9 below.

9. EXCHANGES

The Customer has a period of 15 days from the date of delivery of the order to make the exchange. If you have ordered several items in the same order but these were delivered on different dates, the 15-day period will start from the date of delivery of the last item ordered.

Exchanges may be made in person at Sacoor stores (except outlet stores and Sacoor One). If the Customer wishes to make an exchange at home, they should consult the procedures applicable to returns in Clause 10 below or contact the Customer Care team using the contact details indicated in Clause 12 below.

Items that have been made according to the Customer's specifications or that are clearly personalized do not grant the Customer the right to exchange.

Sacoor does not exchange any items that, due to their nature, do not allow for exchange for hygiene/safety reasons.

10. RETURNS

The Customer has a period of 15 days from the date of delivery of the order to make the return, freely and without any reason. If you have ordered several items in the same order but these were delivered on different dates, the 15-day period will start from the date of delivery of the last item ordered.

The Customer may return items purchased on the Website at no additional cost, provided that they are returned without any signs of use (the Customer may inspect the item with due care, provided that this does not cause any depreciation to it), with the corresponding internal label and using the packaging in which the items were delivered.

The Customer may return any item from the order within the period indicated and in accordance with the procedures set out in the Returns and Refunds section, which can be found at https://www.sacoorbrothers.com/pt/devolucoes-reembolsos/

Sacoor is not obliged to reimburse the additional costs of delivering the order if the Customer has chosen a shipping method that is more expensive than the standard shipping method (method proposed by Sacoor).

If the return was made at a Sacoor boutique, the refund will be made within a maximum period of 15 working days after the request, via bank transfer.

Items that have been made according to the Customer's specifications or that are clearly personalized do not give the Customer the right to return.

Sacoor does not return any items that, by their nature, do not allow for return for hygiene/safety reasons.

11. INTELLECTUAL PROPERTY

The products sold by Sacoor are designed by Sacoor or authorized suppliers or their licensees and are protected by applicable intellectual property laws.

Unless expressly authorized in writing by Sacoor, the Customer may not copy or reproduce the products ordered and/or purchased through the Sacoor website.

14. PROMOTIONS AND OTHER PROGRAMS

The T&C apply without prejudice to any benefits that the Customer may enjoy by virtue of belonging to the Sacoor Club or any promotions, points plans or similar programs that may apply to it.

15. APPLICABLE LAW AND DISPUTE RESOLUTION

The T&C shall be governed by Portuguese law. The competent court to judge all issues arising from these T&C shall be the District of Lisbon (Portugal), with express waiver of any other.

SACOOR CLUB

Loyalty Program Terms & Conditions

GENERAL OBSERVATIONS

A) Sacoor Club is the loyalty program (the "Program") operated by Sacentro - Comércio de Têxteis SA, its subsidiaries, affiliates, group companies and companies under the same ultimate beneficial ownership or management control ("Sacoor Brothers").

B) The Program allows participants (“Members”) the opportunity to earn and redeem points when making a valid purchase at a Sacoor Store Participating in the Program.

C) Sacoor Brothers may also partner with another supplier of goods or services and allow them to participate in the Program from time to time (“Program Partners”) (which may include, but are not limited to, financial and banking institutions, hotels, recreational and leisure services), expanding the benefits that each Member may benefit from in the Program.

D) These terms and conditions (the “Terms and Conditions”) relate to participation, earning and redemption of points under the Program since its launch.

MEMBERS

1) Joining the Program and Sacoor Club is free.


2) The Program does not have an associated card.


3) Anyone interested in joining the Program and becoming a Member can sign up online at sacoorbrothers.com to create a member account, accepting these Terms and Conditions. Alternatively, Sacoor Brothers staff will be happy to assist you in this process at one of the Sacoor Brothers stores participating in the Program.


4) Eligible members must have reached the age of majority in the country where they registered for the Program (“Base Country”).

5) Membership is personal and non-transferable, and you are considered an authorized Member. You may cancel your membership at any time by notifying Sacoor Brothers in writing.


6) By joining the Program, Members unconditionally accept Sacoor's Privacy Policy and grant their express consent to Sacoor Brothers to collect, retain, use and disclose information contained in the Sacoor Club membership form or provided to Sacoor Brothers or Program Partners pursuant to the Program and their other personal information, including but not limited to their name, email address, postal address, contact numbers, date of birth and transaction details, etc., subject to all applicable data privacy laws.


7) Sacoor Brothers has the right to disclose and share with Program Partners, allowing them to use/retain personal information for any of the above-mentioned purposes, including contacting you strictly in relation to the Program.


8) All Members must identify themselves at a Sacoor Participating Store, presenting a valid identification document to enjoy Points and redeem benefits.


9) Each Member can manage their account by logging into their Sacoor Club account.

GENERAL POINTS

1) Sacoor Club allows you to earn Tier Points (Tier Points or “Points”) with every valid purchase you make at all Participating Stores.


2) Tier Points are collected in the account immediately when each Member makes a purchase, helping them to enter a wider world of benefits - Silver, Gold or Platinum member status.


I. The number of Tier Points you must accumulate to reach Silver, Gold or Platinum status is: ww.sacoorbrothers.com/pt/club/.

II. In case of return or refund of any purchases, Points are immediately deducted from your account.

III. Membership status (Silver, Gold or Platinum status) is valid for a maximum period of 12 months, starting from the date on which the Member receives such status and until the annual review date. If, during that period, the Member has accumulated sufficient Tier Points to qualify for a Tier upgrade, such qualification occurs before that date.

IV. If you qualify for a downgrade on your annual review date, you can still enjoy the benefits of your previous status for an extra month.

ACCEPTANCE, REPRESENTATIONS, WARRANTIES AND LIABILITY

1) It is the Member's responsibility to carefully read, agree to and accept these Terms and Conditions. Your continued membership, collection of any Points under the Program, will signify your acceptance of the Program together with its rules, terms and conditions, as revised and updated from time to time. If you do not agree (or cannot comply) with the Terms and Conditions, you may cancel your membership at any time.


2) Member represents, warrants and confirms that he/she has the capacity to understand, agree to and adhere to these Terms and Conditions as set forth herein.


3) To the maximum extent permitted by law, Sacoor Brothers expressly disclaims and excludes liability for any damages, including without limitation, direct, indirect, special, punitive, incidental or consequential loss, any liability for claims, damages, costs, losses or consequences, and damages suffered by a Member in connection with the use, inability to use or results of use of any of the benefits granted under the Program and for any other loss or damage of any nature, whether foreseeable or not, whether due to negligence or omission.


4) Sacoor Brothers reserves the right, with or without reason and without prior notice, to refuse to award Points or withdraw Points in the event of non-compliance with these Terms and Conditions, non-payment of purchases made or in the event of fraud, theft or any other unlawful act or act likely to cause damage to Sacoor Brothers.


5) All express or implied warranties, representations, terms and conditions relating to these Terms and Conditions not contained herein are excluded to the fullest extent permitted by law.

CHANGE, SUSPENSION AND TERM

1) These Terms and Conditions are subject to change from time to time.


2) Sacoor Brothers reserves the right to modify, suspend or terminate the Program, or to change, suspend, cancel or withdraw, in part or in whole, these Terms and Conditions, at any time and at its sole discretion. Sacoor Brothers will communicate to Members such changes, suspension or termination of the Terms and Conditions as soon as possible.


3) Sacoor Brothers reserves the right to temporarily or permanently interrupt participation in the Program - existing or new - for technical, commercial or legal reasons.

APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed by and construed in accordance with Portuguese law. Any dispute arising out of or in connection with these Terms and Conditions, including any question concerning their existence, validity, enforcement or termination, shall first be resolved amicably within 45 days of notification from one party to the other.
If resolution is not possible within the aforementioned 45-day period, the parties may submit such dispute to the non-exclusive jurisdiction of the competent judicial courts of the District of Lisbon, Portugal.
