These terms and conditions (“T&C”) constitute a legally binding agreement and integrate the terms and conditions that govern the acquisition from SACNET, SA, a company incorporated under Portuguese law and registered in the commercial registry office of Cascais under number legal person identification 509791484, with headquarters in Talaíde Park, Estrada Octávio Pato, nº 177, Edif. A, A3, 2785-783 S. Domingos de Rana , (“Sacoor”) by any customer of Sacoor Brothers (“Customer”) of articles through the website www.sacoorbrothers.com ("Web site").

The Website is operated by Sacoor.

The Customer must ensure that they have carefully read the information contained in these T&C, taking into account that they will be directly applicable to the order of items placed through the Website.

By accepting the T&C, the Customer declares that they have the necessary capacity to conclude the Contract, namely the age of majority (18 years old), and that they understand and accept to be bound by all of its provisions.

If the Customer is a legal person, these T&C will apply with the necessary adaptations.

1. ORDERING AND PAYMENT

It is currently only possible to order electronically and receive items from Sacoor in the following countries: Albania, Andorra, Armenia, Austria, Belarus, Belgium, Bosnia and Herzegovina, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Georgia , Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein Lithuania, Luxembourg, Macedonia, Malta, Moldova, Monaco, Montenegro, Netherlands, Norway, Poland, Portugal, San Marino, Serbia, Slovakia, Slovenia, Spain, Sweden, Turkey, Vatican City.

When placing the order, the Customer must choose the payment method. Sacoor has the following means of payment: (i) credit card, (ii) provision of reference for payment by ATM (exclusive to Portugal), (iii) MBWAY (exclusive to Portugal), (iv) Paypal and (v) Klarna . As long as all conditions are met, the Customer may also pay part or all of the order price with their reward points accumulated through Sacoor Club.

By clicking on the “Authorize Payment” option, the Customer accepts that he intends to pay the total amount indicated for the item(s) purchased, including any costs related to shipping and delivery thereof( s). When paying by Multibanco, the Customer must pay for the order within 3 (three) days of placing the order, under penalty of it being canceled and considered void.

The delivery address for purchased items will be that stated in the order.

Once the order has been placed and the necessary checks have been carried out by Sacoor, including confirmation of payment for the order, the Customer will receive an email acknowledging receipt of the order.

If, within five days after sending notice of receipt of the order, Sacoor is unable to ship the order, it will inform the Customer of this fact and may cancel the order.

2. INVOICE

The Customer may request the issuance of an invoice with their data, including their tax number, and must place such information in the respective fields where data relating to the issuance of the invoice is requested.

3. ORDER STATUS

Sacoor will inform the Customer, via email, as soon as it begins preparing the order, also informing it of its progress and including a link that will allow you to monitor the status of the order.

As soon as the order is ready for delivery, the Customer will receive an email with the expected delivery date. The delivery point will be the delivery address indicated by the Customer, a Sacoor boutique or one of the participating Pick up points, as chosen by the Customer.

The Customer can also monitor the status of their order through the field “Orders Placed ” when logging into the Website.

The Customer may contact Sacoor's Customer Care service to obtain information about the delivery of an order, using the contact details indicated in Clause 12 below.

4. MODIFICATION AND CANCELLATION OF THE ORDER

The Customer may modify their order until it is in the “Order in Preparation” status. You may also withdraw within 14 days.
For more information on how to confirm your order status, please see Clause 12 below.
To modify or cancel the order, the Customer must contact Customer Care as quickly as possible, using the contact details indicated in Clause 12 below.

5. DELIVERY CONDITIONS

The Customer will receive their order at their preferred address (with the exception of post office boxes), at a Sacoor boutique of their choice or at one of the participating Pick Up points.

Shipping fees will apply per order. The exact price of each shipment will depend on the country and delivery conditions and are detailed in the email receiving the order.

Deliveries are made from 9am to 6pm local time. To receive the order, you must ensure that someone is at the address indicated. During promotion periods, the delivery time may be longer than usual, but never longer than 30 days from the order date.

The following holidays will not be considered “business days” for the purposes of any deadline for shipping the respective order to the carrier:

Delivery deadlines after dispatch may only be met in the event that there are no external factors beyond the reasonable control of Sacoor or its suppliers that make this impossible, such as holidays in the delivery locations or in the countries through which the goods travel, such as holidays, earthquakes, acts of terrorism, floods, general strikes, riots, rebellions or coups d'état.

6. IMPOSSIBILITY OF DELIVERY

In cases where the Customer has chosen home delivery, the Customer must ensure that they are at the address indicated at the time of delivery of the order (or someone who on their behalf can sign the proof of delivery). If, after two home delivery attempts, the Customer is not available to receive the order, new information will be made available to the Customer regarding the location where they can collect it. The Customer will have a period of 15 working days from the day of the second delivery attempt to collect the order at the indicated location. If the Customer does not collect the order within the indicated period, Sacoor will collect it and return the total amount paid by the Customer, with the exception of the costs incurred in sending the order.

If the Customer has chosen to receive the order at a Sacoor boutique, they must collect it from the selected boutique within fifteen days following delivery confirmation. At the end of this period, without the Customer having collected the order, it will be returned to the Sacoor warehouse and cancelled. In the event of cancellation of the order due to failure to collect it within the period provided above, Sacoor will reimburse the Customer for the full amount, with the exception of costs related to shipping the order, if applicable.

If the Customer has chosen to collect the order at a Pick Up point, he or she will have to collect it at the chosen Pick Up point within fifteen days of delivery confirmation, under penalty of it being returned to Sacoor and cancelled. In the event of cancellation of the order due to failure to collect it within the deadline set out above, Sacoor will reimburse the Customer for the full amount, with the exception of the costs incurred in sending the order.

7. TRANSFER OF RISK

The risk of deterioration of the ordered items is borne by the Customer from the moment they are delivered.

8. GUARANTEES

The items delivered to the Customer will, as a rule, correspond to those selected on the Website, except in cases where a given item has been manufactured using artisanal processes (brushing, waxing, aging, etc.) in which small differences may be observed between items of the same reference.

Sacoor only sells items in perfect condition, so if, exceptionally, the Customer receives a defective item, Sacoor will comply with all obligations set out in applicable legislation relating to warranty. In this case, the Customer must contact Customer Care using the contact details indicated in Clause 12 below.

If the Customer is not satisfied with any item received due to faults in material or manufacturing, including any damage incurred in transit, they may return the items in accordance with the returns instructions set out in Clause 9 below.

9. EXCHANGES

The Customer has a period of 15 days from the date of delivery of the order to exchange it. If you have ordered several items in the same order but they were delivered on different dates, the 15 day period will run from the day of delivery of the last item ordered.

Exchanges can be made in person at Sacoor stores (except outlet and Sacoor One stores). If the Customer wishes to make an exchange at home, they must consult the procedures applicable to returns in Clause 10 below or contact the Customer Care team using the contact details indicated in Clause 12 below.

Items that were made according to the Customer's specifications or that are clearly personalized do not grant the Customer the right to exchange.

Sacoor does not exchange any items that, due to their nature, do not allow exchange for hygiene/safety reasons.

10. RETURNS

The Customer has a period of 15 days from the date of delivery of the order to return it, freely and without any reason. If you have ordered several items in the same order but they were delivered on different dates, the 15 day period will run from the day of delivery of the last item ordered.

The Customer may return items purchased on the Website at no additional cost as long as they are returned without any signs of use (the Customer may inspect the item with due care as long as it does not cause any depreciation to it), with the corresponding label internally and using the packaging in which the items were delivered to you.

The Customer may return any item in the order within the deadline indicated and in accordance with the procedures contained in the Returns and Refunds section which is accessible at https://www.sacoorbrothers.com/pt/returns-reembolsos/

Sacoor is not obliged to reimburse additional delivery costs for the order if the Customer has chosen a more expensive shipping method than the standard shipping method (the method proposed by Sacoor).

If the return was made at a Sacoor boutique, the amounts will be returned within a maximum period of 15 working days after the request, via bank transfer.

Items that were made according to the Customer's specifications or that are clearly personalized do not entitle the Customer to a return.

Sacoor does not return any items that, by their nature, do not allow return for hygiene/safety reasons.

11. INTELLECTUAL PROPERTY

The products sold by Sacoor are authored by Sacoor or authorized suppliers or its licensors and are protected by applicable intellectual property laws.

Unless Sacoor expressly authorizes it in writing, the Customer may not copy or reproduce the products ordered and/or purchased through the Sacoor website.

The T&C apply without prejudice to any benefits that the Customer may enjoy as a result of belonging to the Sacoor Club or any promotions, points plans or similar programs that are applicable to them.

15. APPLICABLE LAW AND DISPUTE RESOLUTION

The T&C will be governed by Portuguese law. To judge all issues arising from these T&C, the jurisdiction of the District of Lisbon (Portugal) is established as competent, expressly renouncing any other.

SACOOR CLUB

Loyalty Program Terms & Conditions

GENERAL OBSERVATIONS

A) Sacoor Club is the loyalty program (the "Program") operated by Sacentro - Comércio de Têxteis SA, its subsidiaries, affiliates, group companies and companies under the same ultimate beneficial ownership or management control ("Sacoor Brothers ").

B) The Program allows participants ("Members") the opportunity to earn and redeem points when making a valid purchase at a Sacoor Store Participating in the Program.

C) Sacoor Brothers may also enter into a partnership with another supplier of goods or services and allow them to participate in the Program from time to time, (“Program Partners”) (which may include, but is not limited to, financial and banking institutions, hotels, recreational and leisure services), expanding the advantages that each Member can benefit from in the Program.

D) These terms and conditions (the “Terms and Conditions”) relate to the participation, earning and redemption of points under the Program since its launch.

MEMBERS

1) Membership of the Program and the Sacoor Club is free.


2) The Program does not have an associated card.


3) Anyone interested in joining the Program and becoming Members can sign up online atacoorbrothers.com to create a member account, accepting these Terms and Conditions and . Alternatively, the Sacoor Brothers staff will be happy to assist you in this process at one of the Sacoor Brothers stores participating in the Program.


4) Eligible members must have reached the age of majority in the country where they signed up for the Program ("Base Country").

5) Membership is personal and non-transferable, being considered an authorized Member. You can cancel your membership at any time and must notify Sacoor Brothers in writing.


6) By joining the Program, Members unconditionally accept Sacoor's Privacy Policy, as well as grant their express consent to Sacoor Brothers to collect, retain, use and disclose information contained in the Sacoor Club membership form or provided to Sacoor Brothers or to Program Partners under the Program and your other personal information, including but not limited to your name, email address, address, contact numbers, date of birth and transaction details, etc., Subject to all applicable data privacy laws.


7) Sacoor Brothers has the right to disclose and share with Program Partners, allowing to use/retain personal information for any of the aforementioned purposes, including contacting you strictly in relation to the Program.


8) All Members must identify themselves at a Sacoor Participating Store, presenting a valid identification document to enjoy the Points and redeem the benefits.


9) Each Member can manage their account by logging into their Sacoor Club account.

GENERAL POINTS

1) Sacoor Club allows you to earn Tier Points with each valid purchase you make at all Participating Stores.


2) Tier Points are collected in the account immediately when each Member makes a purchase, helping them to access a wider world of benefits - Silver, Gold or Platinum member status.


I. The number of Tier Points you must accumulate to reach Silver, Gold or Platinum status is: ww.sacoorbrothers.com/pt/club/.

II. In case of return or refund of any purchases, Points are immediately deducted from your account.

III. Membership status (Silver, Gold or Platinum status) is valid for a maximum period of 12 months, from the date the Member receives that status and until the annual review date. If, during this period, you have accumulated enough Tier Points to qualify for a Tier Up, that qualification occurs before that date.

IV. If you qualify for a step down on the annual review date, you can still enjoy the benefits of your previous status for an extra month.

ACCEPTANCE, REPRESENTATIONS, WARRANTIES AND LIABILITY

1) It is the Member's responsibility to carefully read, agree and accept these Terms and Conditions. Your continuation as a Member, the collection of any Points under the Program, will mean acceptance of the Program together with its rules, terms and conditions, its revisions and updates from time to time. If you do not agree (or cannot comply) with the Terms and Conditions, you can cancel your membership at any time.


2) The Member represents, warrants and confirms that he or she has the ability to understand, agree to and adhere to these Terms and Conditions as set out here.


3) To the maximum extent permitted by law, Sacoor Brothers expressly disclaims and excludes liability for any damages, including without limitation, direct, indirect, special, punitive, incidental or consequential loss, any liability for claims, damages, costs, losses or consequences, and damages suffered by a Member in connection with the use, inability to use or results of the use of any of the benefits granted under the Program and for any other loss or damage of any nature, foreseeable or not, due to negligence or omission.


4) Sacoor Brothers reserves the right, with or without reason and without prior notice, to refuse to award Points or withdraw Points in the event of non-compliance with these Terms and Conditions, non-payment of purchases made or in the event of fraud, theft or any other unlawful act or capable of causing harm to Sacoor Brothers.


5) All express or implied warranties, representations, terms and conditions relating to these Terms and Conditions not contained herein are excluded to the fullest extent permitted by law.

AMENDMENT, SUSPENSION AND TERM

1) These Terms and Conditions are subject to change from time to time.


2) Sacoor Brothers reserves the right to modify, suspend or terminate the Program, or to alter, suspend, cancel or withdraw, partially or in full, these Terms and Conditions, at any time and at its sole discretion. Sacoor Brothers will communicate such changes, suspension or termination of the Terms and Conditions to Members as soon as possible.


3) Sacoor Brothers reserves the right to temporarily or permanently interrupt participation in the Program - existing or new - for technical, commercial or legal reasons.

APPLICABLE LAW AND JURISDICTION

These Terms and Conditions are governed and interpreted in accordance with Portuguese law. Any dispute arising from or related to these Terms and Conditions, including any question relating to their existence, validity, compliance or termination, will first be resolved amicably within 45 days of notification from one party to the other.
If resolution is not possible within the aforementioned period of 45 days, the parties may submit such dispute to the non-exclusive jurisdiction of the competent judicial courts of the District of Lisbon, Portugal.
